End User Licence Agreement
The licence you receive when you buy a plug-in: what you may install, how many machines, and what is not permitted.

Unreviewed draft
This document is a working draft prepared in-house. It has not yet been reviewed by a qualified legal professional and is published here for comment, not as vetted legal advice. If something in it affects a decision you are making, email legal@fatberrydsp.com before relying on it.
1. Licence grant
Fusia Tech Ltd grants you a perpetual, non-exclusive, non-transferable licence to install and use the purchased software, subject to this agreement.
You are buying a licence to use the software. You are not buying the software itself; all intellectual property in it remains ours.
2. Machines and activations
A single-user licence may be activated on up to 3 machines at the same time (for example a studio desktop, a laptop and a home system) provided you are the only person using them.
You can deactivate a machine from your account at any time, which frees the activation for another. If a machine is lost or fails, support can release its activation.
Studios needing concurrent use by more than one person need one licence per user. Contact support@fatberrydsp.com for multi-seat arrangements.
3. What you may do
- Install the VST3 and Audio Unit builds on your permitted machines.
- Use the software commercially. Music, audio and audiovisual work you produce with it is yours, and we claim no rights in it and no royalties.
- Make backup copies of the installers for your own use.
- Use the factory presets in your own productions, and share your own user presets.
4. What you may not do
- Share, publish, resell or sub-licence a licence key, or use one on machines belonging to other people.
- Circumvent, disable or reverse-engineer the activation system.
- Decompile, disassemble or otherwise reverse-engineer the software, except to the limited extent that this cannot lawfully be prohibited.
- Rent, lease or provide the software as a hosted or remote-access service.
- Remove or obscure copyright notices or branding within the software.
- Redistribute factory presets as a commercial preset pack.
5. Transferring a licence
A licence may be transferred to another person once, permanently, and only for the whole licence. Bundles transfer as a whole and cannot be broken apart.
To transfer, email support@fatberrydsp.com from the address on the account with the recipient name and email address. We deactivate every existing activation, move the licence, and confirm to both parties. We do not charge a transfer fee.
A licence obtained under an educational, NFR or promotional discount cannot be transferred. A licence that is the subject of an open refund request or chargeback cannot be transferred until that is resolved.
6. Updates and support
All maintenance, bug-fix and major-version updates to the licensed product are free for life. This does not include separate future products.
Support covers installation, activation and defects. It does not cover general audio-engineering advice, although we are usually happy to help anyway.
7. Warranty and liability
We warrant that the software will perform substantially as described on its product page. If it does not, tell us and we will fix it or refund you.
Beyond that, and to the extent the law allows, the software is provided as is. We are not liable for lost sessions, lost recordings, lost profits or studio downtime, and our total liability is limited to what you paid for the licence.
If you are a consumer, your statutory rights are not affected by anything in this section.
8. Termination
This licence ends automatically if you materially breach it, in practice, if you distribute keys or defeat activation. On termination you must uninstall the software and destroy your copies.
Termination does not affect work you have already produced with the software.
9. Third-party components
The software includes open-source components. Their licence texts and attributions are installed alongside the plug-ins and are available on request. Nothing in this agreement restricts rights you have under those licences.
10. Free trials
A free trial is an evaluation licence, not a purchase. It lets you use the full plug-in for 30 days from the moment it starts, on up to 2 machines, and it is activated from the plug-in by signing in to your account in a browser. No payment details are needed.
Each person may have one trial of each plug-in. Opening further accounts, or reusing a machine that has already run a trial, to obtain another trial of the same plug-in is not permitted.
When the trial ends the plug-in stops processing audio, whether or not the machine is online, until you buy a licence. Sessions that use it still open. Buying the plug-in replaces the trial with the perpetual licence in section 1, without reinstalling.
Sections 3, 4, 7, 8 and 9 apply to a trial as they do to a bought licence. A trial cannot be transferred, and we may end a trial early if it is being misused.
